Terms and Conditions

Bike Servicing

Prior to carrying out any work, our mechanic will undertake an assessment of your bicycle to determine the condition of your bicycle and will contact you to advise of any additional work that may be required and/or parts that may require replacing in addition to the original work requested and the costs of this additional work.

Motion Cycle Repairs Limited will not undertake any additional work or replace any parts without your consent. However, if you choose not to follow our recommendations, Motion Cycle Repairs Limited cannot guarantee that your bicycle will work as it should and Motion Cycle Repairs Limited accepts no liability for any defects arising with the bicycle as a result of not having this work undertaken.

There may be occasions where it is necessary for us to sub-contract the work (or part thereof) to a third party. However, Motion Cycle Repairs Limited will remain responsible for the actions of any sub-contractor and this will not affect your statutory rights.

Should you chose not to proceed with any work after having us undertake an assessment of your bicycle, you will be liable for a £15 charge to cover the time spent by our mechanic preparing your assessment. This will be charged upon collection or redelivery of your bicycle to the original collection address.

Completion of Work

Motion Cycle Repairs Limited will endeavour to complete any work to your bicycle as soon as possible and within the estimated time scales that Motion Cycle Repairs Limited have provided you with. However, there may be times when this is not possible and time for completion of this work will not be of the essence.

Price & Payment

The price for the work (including any additional work which you have authorised us to carry out) will be as quoted to you by a Motion Cycle Repairs Limited mechanic.

Payment in full is required on completion of any work undertaken to your bicycle and prior to the return of your bicycle. Motion Cycle Repairs Limited reserves the right to retain your bicycle until you have paid in full.

All electronic invoices are required to be paid within 7 days of the date shown.

Any parts specially ordered must be paid in full beforehand and cannot be returned for credit.

Collection of Bicycles

You must collect your bicycle within 7 days of Motion Cycle Repairs Limited notifying you that it is available. If you fail to do so, Motion Cycle Repairs Limited will provide you with a written notice (which includes email) notifying you that you have 21 days to collect your bike, failing which Motion Cycle Repairs Limited may sell the bicycle.

Motion Cycle Repairs Limited is entitled to deduct any outstanding payment due from you for the work from the proceeds of any sale of your bicycle, together with any costs of sale, and if applicable, Motion Cycle Repairs Limited will then send you a cheque for the remaining proceeds of the sale.

Warranty

Subject to the remainder of this clause, all replacement parts provided by Motion Cycle Repairs Limited as part of this service will be guaranteed for a period of 12 months, and all labour and workmanship is guaranteed for a period of 30 days, commencing from the date of collection once works have been completed.

This warranty is subject to you:

(a) maintaining the bicycle in accordance with the manufacturer’s warranty;

(b) providing proof of purchase of the service / repair; and

(c) allowing Motion Cycle Repairs Limited to carry out the repair work required.

This warranty is not valid where, in Motion Cycle Repairs Limited reasonable opinion, defects with the bicycle have occurred due to fair wear and tear, improper use, criminal or malicious damage, fire, theft, instances where the bicycle has been used in an incorrect manner or you have continued to use the bicycle after the defect or fault developed.

Risk

Any personal items left on the bicycle when it is provided to Motion Cycle Repairs Limited are left at the customer's own risk and Motion Cycle Repairs Limited accepts no liability for any loss or damage to these items. Motion Cycle Repairs Limited recommends you remove any such items prior to handing over your bike for repair. These items include, but are not limited to; GPS cycle computers, water bottles, saddle bags and the contents therein. This list is not exhaustive.

Liability

If Motion Cycle Repairs Limited fail to comply with these conditions, Motion Cycle Repairs Limited will attempt to repair the issue for you as soon as possible, which may include providing you with replacement parts.

Under no circumstances will Motion Cycle Repairs Limited be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill, stress or inconvenience) howsoever arising out of any problem you notify to us under these terms and conditions and Motion Cycle Repairs Limited shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the service.

Nothing in these terms and conditions is intended to limit any of your statutory rights or in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Data

All personnel data held will be used solely by Motion Cycle Repairs Limited and will not be viewed by any third parties. All information will be stored in accordance with the Data Protection Act.

General

These terms are governed by the applicable law in your country but are subject to the exclusive jurisdiction of the courts of Scotland.

Motion Cycle Repairs Limited amends these terms from time to time. The terms in force at the time of the work being undertaken apply to the Contract between you and us.
